When we refer to “our website”, we mean all websites, including this one, that are owned and operated by us. 


1.2    When you read words that refer to “us”, “our” or “we”, it means Stratus Digital [ACN 682557688] and the words “you”, “user” or “your” means you, the person or business who is using our website and any additional features. You can contact us on the details provided. Our website can also include all forms of digital media and expression, such as social media pages, platforms, email communications, blogs, images or information published on our website.

 

1.3    By using our services or our website, you are agreeing to be automatically bound by these terms and conditions and our privacy policy. These collectively form our “terms” with you.

4.   No unlawful or prohibited use

You may not use our website in any manner which could damage, disable, overburden, or impair this website or interfere with any other party's use and enjoyment of our website. You agree not to hack into areas of our website that are not intentionally made available to you.

5.1    We do not offer change of mind refunds, discounts, or credits.
5.2    We do not warrant, either express or implied, that the use of our services will result in increased profits, improved success, or any specific business outcomes. We aim to equip leaders with the tools they need to navigate and lead transformational change, increasing productivity across the relevant government sectors, but you are ultimately responsible for growing and developing your business, brand, and reach.

 

6.    How We Work


6.1    Consultation and Demonstration - Prior to purchasing our services, you may schedule a consultation to discuss your needs and view a demonstration of the services offered. This process allows you to make an informed decision about the suitability of our services for your purposes.
6.2    Purchase of Services - After the consultation and demo, you can purchase our services through our website. Detailed instructions for the purchase process will be provided during the consultation and will be available on our website. 
6.3    Access Period - Upon payment for the relevant services, you will be granted access to the services for a period of six (6) months from the date of purchase. During this period, you will have unlimited access to complete the services.
6.4    PIN and Access Link - Upon successful purchase of our services, you will receive a unique link and a Personal Identification Number (“PIN”) via email. This link and PIN will provide you with the necessary access to the services for the entire six (6) month access period.
6.5    Unlimited Access - The provided link and PIN entitle you to unlimited usage of the services within the six (6) month period. It is your responsibility to ensure the confidentiality of the PIN to prevent unauthorised access.
6.6    If you make an enquiry on our website using third party authentication (such as through Facebook or Google login) you give us access to some of your personal information included on those platforms and consent to our use of that information. Please consider this personal information before you select this option. 
6.7    We reserve the right to suspend or terminate our services if we believe that you are in breach of any of these terms and conditions.
6.8    We are not responsible for the actions or comments of other users. While under no obligation to do so, we reserve the right to moderate our social media accounts and remove or suspend users that so not comply with these rules. We also reserve the right to turn off commenting on our social media accounts if we deem it appropriate to do so. 
6.9    You may use your PIN and Access Link on more than one device. If we suspect you have shared your PIN and Access Link with another person, your account may be temporarily suspended or blocked while we investigate. If, as a result of our investigation, we reasonably determine you are in breach of these terms, without limiting any other rights we may have, we reserve the right to terminate our services with no refund and prohibit you from opening a new account. 
6.10    You are solely responsible for securing and protecting your PIN and Access Link and may be liable for any loss to us or third parties caused as a result of any unauthorised use of your PIN and Access Link, whether by an authorised person or not.
 

7.    Payments and refunds

 
7.1    Prices for our services are subject to change without notice and access for new users may be discontinued or modified at any time. 
7.2    We accept one-off and recurring payments either by way of direct bank transfer to our nominated bank account or via secure third-party payment gateways such as Stripe. Payments are handled by Stratus Digital. We do not keep your payment details.
7.3    Access to our services is granted upon receipt of payment. 
7.4    Access to our services is granted upon receipt of payment. Payments for our services are non-refundable except in accordance with the Australian Consumer Law Consumer Guarantees. Refunds are not available for change of mind.
7.5    In accordance with Australian Consumer Law Consumer Guarantees, you may be eligible for a refund in the following instances:
a)    the product has a major fault that would have prevented a reasonable consumer from purchasing the product if they had known about the fault.
b)    the product is significantly different from the sample or description provided.
c)    the product is unfit for its intended purpose, and this defect cannot be easily remedied.
d)    the product does not match the quality, state or condition that was explicitly promised.
7.6    In instances of a minor fault, we will endeavour to repair the fault or offer a replacement. If the issue cannot be fixed within a reasonable time, you may choose between a replacement, refund, or compensation.
7.7    Refunds will be processed using the original payment method. 
7.8    To request a refund, please contact us within seven (7) business days of discovering the fault, providing proof of purchase and detailed information regarding the issue.


8.    Copyright, Trademarks and other Intellectual Property 


8.1    Stratus Digital owns the intellectual property rights in the contents of this website or has permission to use or display the material on this website. You may not use, copy, display, distribute, modify, translate, reformat, incorporate into advertisements or other works, promote, create derivative works, or in any way exploit or allow others to exploit any of our website content in whole or in part except as expressly authorised by us. 
8.2    By using our services, we grant you a license to access our services. This does not constitute a transfer of title. This license will automatically terminate six (6) months after date of purchase of our services, or if you violate any of these restrictions or our terms and may be terminated by Stratus Digital at any time.
8.3    Images and material posted on this website by third parties are the responsibility of those third parties and may be subject to copyright. You must seek permission from the third party before using any of their content. 
8.4    Permission: If material is made available for you to do so, you may access, download, or print material from the website for your personal use only. Sharing without prior permission is expressly prohibited. You are not permitted to use our copyright material for commercial profit of any sort. This means you cannot resell our services or copyright material without our express written permission.  You agree not to change or delete any copyright or proprietary notice from materials downloaded from this website or any site accessible through this website.

12.3    In the context of this agreement, “consequential loss” includes any consequential loss, indirect loss, real or anticipated loss of profit, loss of benefit, loss of revenue, loss of business, loss of goodwill, loss of opportunity, loss of savings, loss of reputation, loss of use and/or loss or corruption of data, whether under statute, contract, equity, tort (including negligence), indemnity, or otherwise. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.
12.4    We will not be liable to you or any other person or entity for any damages whatsoever arising as a result of your use of our website in any way, subject to the requirements of Australian Consumer Law. Where warranties are implied by law, you acknowledge and agree that the total aggregate liability to us is limited to the greater of the amount we have received in payment from you in the six (6) months immediately preceding the claim, or one hundred dollars ($100.00 AUD) only. This limitation of liability applies to the fullest extent permitted by law and shall survive any termination or expiration of this agreement or your use of our website or the services found on our website.

As such, we do not provide nationally recognised training or qualifications upon completion of our courses. 
15.4    You further acknowledge that it is your responsibility to seek appropriate professional or accredited training if required for your specific needs or industry compliance.
